Terms and Conditions

These terms are between ConchX LTD (“we”) and the business that registers with Repeat (“you”). By registering, you confirm that you can agree to them for the business.

ConchX LTD is registered in England and Wales, company number 09916195. Our registered office is Venture House, 2 Arlington Square, Bracknell RG12 1WA.

1. What Repeat is

Repeat is a digital diary that helps food businesses keep the records in the Food Standards Agency's Safer Food, Better Business pack: daily checks, temperatures, deliveries, cleaning, allergens, training and the 4-weekly review.

Repeat keeps your records on the business device and a copy in the cloud, so you can move to a new device and the owner can view them from their own phone.

2. Your responsibilities

You are responsible for food safety in your business and for following food law. Repeat helps you record what you do. It does not do the checks for you.

Records must be true and made at the time. Don't record a check that wasn't done.

Keep the Staff PIN, the Owner's and Managers' PINs and the business email safe. Anything recorded with them counts as recorded by your business.

Only add people who work for your business, and tell them that their name is saved with the checks they record.

3. Disclaimer

The guidance in Repeat is based on the FSA's Safer Food, Better Business pack and UK food hygiene law. It is general information, not legal or professional advice, and it may not cover every food, process or part of the UK.

Using Repeat does not guarantee a food hygiene rating, the result of an inspection, or that your business meets the law.

If you're not sure what your business needs, ask your local council's food safety team. Special processes, such as sous vide, vacuum packing, curing or smoking, need their own food safety plan agreed with your council.

4. Subscription and payment

Repeat costs £17.99 a month for each business, including VAT. Each new subscription starts with a 7-day free trial.

You subscribe and pay through the Apple App Store or Google Play, and their terms apply to the payment. The subscription renews every month until you cancel it.

You can cancel at any time in your App Store or Google Play account. Cancel at least 24 hours before the renewal date to avoid the next payment. There is no contract and no cancellation fee.

Refunds are handled by Apple or Google under their rules.

If the price changes, we'll tell you at least 30 days before. Where needed, Apple or Google will ask you to agree to the new price.

The owner's own phone, used only to view the records, doesn't need its own subscription.

5. Your records and data

Your records belong to your business. You can make the inspection report at any time.

We keep a copy securely with Google Cloud in London. We use your data only to run Repeat and to help you when you contact support, and we handle personal data under UK data protection law. Our Privacy Policy explains how.

6. Personal data we look after for you

Your records include personal data, such as the names of the people who work at your business and anything written about a customer in a complaint. For this data, your business is the controller and we are your processor under UK data protection law. This section is our agreement for that, as Article 28 of the UK GDPR requires.

What we do with it: we store and process your records, about the people who work at your business, your suppliers and your customers, only to provide Repeat as these terms describe, for as long as your business uses Repeat. Using Repeat as it's designed counts as your instructions to us.

We will use the data only on your instructions, unless the law requires otherwise, and tell you if we think an instruction breaks the law. Anyone at ConchX who can see it must keep it confidential, and we keep it secure.

We will help you answer requests from people about their data, and help you meet your own duties on security, data breaches and data protection impact assessments. If we find a breach that affects your data, we'll tell you without undue delay.

We will give you the information you need to show that we meet these duties, and let you or your auditor check, with reasonable notice.

You agree that we can use the companies named in our Privacy Policy to help run Repeat. They must protect the data in the same way, and we remain responsible for them. We'll tell you before we add or change one, so you can object, and if you do, you can cancel. We only send data outside the UK with the protection UK law requires.

When your business stops using Repeat, you can make the inspection report and ask us for a copy of your records. We then delete them as our Privacy Policy explains, unless the law requires us to keep them.

You're responsible for having a lawful reason to record this data, and for telling the people who work for you how it's used.

7. Availability and changes

Repeat works without internet and sends your records to the cloud when you're back online. We work to keep Repeat running, but we can't promise it will never be interrupted.

We may improve Repeat and update these terms. We'll tell you about important changes in the app or by email before they apply.

8. Ending

You can stop using Repeat at any time by cancelling your subscription.

We may suspend or close a business's account if these terms are seriously broken, if the subscription isn't paid, or if Repeat is misused. Where we can, we'll tell you first.

If we decide to stop providing Repeat, we'll tell you by email and in the app at least 90 days before it closes. We'll stop the subscriptions so no more payments are taken, and until it closes you can keep using Repeat and make the inspection report of your records. After it closes, we'll delete your records.

9. If Repeat is sold

We may transfer these terms, and your records, to another company that takes over Repeat, for example if we sell it. We'll tell you before it happens.

Your rights under these terms stay the same. If you don't want to continue with the new company, you can cancel at any time.

10. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit.

We aren't responsible for how your business stores, prepares or sells food, or for fines, closures, hygiene ratings, or loss of business or profit.

Otherwise, our total liability to you is limited to what your business paid for Repeat in the 12 months before the claim.

11. The law

These terms are governed by the law of England and Wales, and the courts of England and Wales can decide any dispute. If your business is in Scotland or Northern Ireland, you can also bring a claim there.
